Action required before publishing
Two items to confirm before publishing: (1) If you become VAT registered, update Section 5 to state that prices are exclusive of VAT and add your VAT number. (2) Review the notice period in Section 7 and confirm the number of days you want (currently set to 30 days). Also insert your ICO registration number in the Privacy Policy if not already done.
About Us and These Terms

These Terms and Conditions ("Terms") govern your use of our website at circadexperformance.com and circadexperformance.co.uk, and any services you purchase or engage with through us. Please read them carefully before making a booking.
By making a booking or purchasing a service, you confirm that you have read, understood, and agree to these Terms. If you do not agree, you should not proceed with a booking.
These Terms do not affect your statutory rights as a consumer under English law.
Our Services
We currently offer the following services:
The Roster Audit
A one-off online consultation in which we analyse your shift pattern and produce a bespoke circadian protocol covering meal timing, sleep architecture, and light exposure. Delivered by video call.
Ongoing Coaching
A recurring coaching programme providing continuous protocol management, HRV review, training plan oversight, and direct access to Jon Goodbourn. Contact frequency and support depth are agreed in advance.
Tactical Interventions
In-person training sessions, sports massage, manual therapies, and education resources delivered at agreed locations in and around Manchester, including hotel visits.
The App / Platform Beta
A digital platform in development. Waitlist registration is free. Pricing and terms for the platform will be provided separately before beta access is granted.
The 3 AM Protocol (free resource)
A downloadable PDF resource provided free of charge. Provision of this resource does not create a contractual relationship or any ongoing obligation.
Service descriptions on our website are for information purposes. While we endeavour to deliver every protocol with skill and care, we cannot guarantee specific outcomes. Individual results will vary depending on adherence, individual physiology, and factors outside our control.
Making a Booking and Contract Formation
A legally binding contract between you and Circadex Performance is formed at the point we send you a written booking confirmation by email, or — where immediate payment is taken online — at the point payment is successfully processed and confirmed.
We reserve the right to decline any booking prior to contract formation, including where we consider a service unsuitable for an individual's needs or health circumstances, or where we have reason to believe false or misleading information has been provided.
Acceptance of a booking does not constitute a guarantee of any particular outcome. It confirms we will deliver the service described with reasonable skill and care.
Prices and Payment
All prices are stated in pounds sterling (GBP). Prices shown are the amounts payable. Circadex Performance is not currently VAT registered; no VAT is added to our prices. If our VAT status changes, we will update these Terms and our pricing accordingly with reasonable notice.
Payment terms are confirmed at the point of booking. For the Roster Audit, full payment is required before the session is confirmed. For Ongoing Coaching and Tactical Interventions, payment terms (including frequency and method) will be agreed at the start of your programme.
We reserve the right to amend our pricing. For Ongoing Coaching, any price change will be communicated at least 30 days in advance and will not apply to any period already paid for.
Your Right to Cancel — Consumer Cancellation Rights
If you are booking as a consumer (that is, for purposes wholly or mainly outside any trade, business, or profession), the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 give you the right to cancel a contract for services within 14 days of entering into it, without giving any reason. This is the statutory cooling-off period.
To exercise this right within the 14-day period, contact us at circadexperformance@gmail.com with a clear statement of your decision to cancel. We will confirm receipt and process any applicable refund within 14 days.
Where the service begins within the cooling-off period
If you ask us to begin providing the service before the 14-day cooling-off period has expired:
- The Roster Audit: By booking and attending a session within 14 days, you acknowledge that the service will be fully performed before the end of the cooling-off period and agree that your right to cancel will be lost once the session has been delivered in full. You will receive written confirmation of this before we proceed.
- Ongoing Coaching: If coaching commences within 14 days of contract formation, you agree that if you subsequently cancel within the cooling-off period, you will be liable to pay a proportionate amount for the service delivered up to the point of cancellation.
- Tactical Interventions: By attending a session, you acknowledge the service has been delivered. Where a session is delivered within 14 days of contract formation at your request, the right to cancel in relation to that session is lost upon delivery.
Cancellation of Ongoing Coaching after the cooling-off period
You may cancel an Ongoing Coaching programme at any time after the cooling-off period by providing 30 days' written notice to circadexperformance@gmail.com. You will be charged for any coaching delivered during the notice period. No refund is due for sessions already delivered.
Cancellation of Tactical Intervention sessions
Where a session is booked and subsequently cancelled by you, the following applies:
- Cancellation with more than 48 hours' notice: full refund or rescheduling at no charge.
- Cancellation with less than 48 hours' notice: 50% of the session fee is payable.
- Non-attendance without notice: the full session fee is payable.
Where we cancel a session, we will offer rescheduling or a full refund. We will not charge a cancellation fee where a cancellation is due to our error.
Our right to cancel
We reserve the right to suspend or terminate a service arrangement where:
- You have provided materially false or misleading information relevant to your programme.
- You have acted in a manner that is abusive, threatening, or inappropriate towards us.
- Continuing the service would, in our professional judgement, present a risk to your health or safety that falls outside our scope of practice.
Where we terminate for the above reasons, you will be refunded for any sessions not yet delivered, less any reasonable costs already incurred.
Health Disclaimer and Scope of Practice
Important — please read before booking
Circadex Performance provides performance coaching, sports rehabilitation support, and lifestyle protocol services. We are not a medical practice. We do not diagnose or treat medical conditions. Our services are not a substitute for advice from your GP or other qualified medical practitioner.
Jon Goodbourn holds a BSc (Hons) in Sports Rehabilitation and is registered with BASRaT (British Association of Sport Rehabilitators and Trainers) and FHT (Federation of Holistic Therapists). All services are delivered within the scope of those qualifications and professional registrations.
If you have any current or pre-existing medical condition, you are strongly advised to consult your GP before beginning any programme with us. You are responsible for disclosing any medical conditions, injuries, or changes in health that may affect your programme. We may decline to work with or continue working with an individual where we consider it clinically appropriate to do so.
Where we believe a presenting issue is beyond our scope of practice, we will say so clearly and, where possible, direct you to an appropriate service or practitioner.
Our Liability
We will provide our services with reasonable skill and care in accordance with our professional qualifications, registrations, and applicable professional standards.
To the maximum extent permitted by applicable law:
- We are not liable for any indirect, consequential, incidental, or special loss arising from our services, including loss of income, loss of opportunity, or any other economic loss.
- Our total liability to you in relation to any claim arising from a service will not exceed the total amount paid by you for that service.
- We are not liable for any failure to deliver a service where that failure arises from circumstances beyond our reasonable control, including illness, bereavement, or other genuine emergencies.
Nothing in these Terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; any breach of the terms implied by the Consumer Rights Act 2015; or any other liability that cannot lawfully be excluded or limited.
Your Responsibilities
By engaging with our services, you agree to:
- Provide accurate, complete, and up-to-date information about your health, roster, lifestyle, and any factors relevant to your programme.
- Inform us promptly of any changes to your health status, including new diagnoses, injuries, or medications, that may affect your programme.
- Exercise your own judgement in following any protocol or advice we provide. You are responsible for stopping any activity that causes pain, discomfort, or distress.
- Not use our services as a substitute for medical assessment or treatment where such treatment is indicated.
- Treat Jon Goodbourn with courtesy and respect in all communications and sessions.
Intellectual Property
All written materials, protocols, plans, PDFs, and resources produced by Circadex Performance are our intellectual property and are provided for your personal use only. You may not reproduce, distribute, publish, sell, or share these materials — in whole or in part — without our prior written permission.
The Circadex Performance name, logo, and brand elements are the property of Jon Goodbourn trading as Circadex Performance. Unauthorised use is not permitted.
Under-18s
We may work with individuals under the age of 18 where we hold the appropriate qualifications to do so. For any individual under 18, a parent or legal guardian must provide written consent before services commence, and must be available to be contacted in the event of any concern arising during a session.
For in-person sessions involving an individual under 16, a parent or legal guardian must be present or in the immediate vicinity unless expressly agreed otherwise in writing.
Complaints
We take all complaints seriously. If you are not satisfied with any aspect of our service, please contact us in the first instance at circadexperformance@gmail.com. We aim to acknowledge complaints within 2 business days and provide a full response within 10 business days.
If you remain unsatisfied after our response, you may escalate to the following bodies depending on the nature of your complaint:
- Professional conduct: BASRaT (basrat.com) or FHT (fht.org.uk), as appropriate.
- Data protection:The Information Commissioner's Office (ico.org.uk).
- Consumer disputes: You may be entitled to apply to the courts of England and Wales, or to seek mediation through a third-party dispute resolution service.
Privacy
Your personal data is processed in accordance with our Privacy Policy, which forms part of these Terms. By booking a service, you acknowledge that you have read and understood our Privacy Policy.
Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising from or in connection with these Terms or our services will be subject to the exclusive jurisdiction of the courts of England and Wales.
If you are a consumer resident in Scotland or Northern Ireland, you may also have the right to bring proceedings in the courts of your home jurisdiction.
Changes to These Terms
We may update these Terms from time to time. The current version will always be available at circadexperformance.com/terms. Material changes will be communicated to active clients by email at least 14 days before they take effect. Continued use of our services after that date constitutes acceptance of the revised Terms.
